General conditions of use

These general terms of use apply to the use of the website of the practice of Docteur Cabinet dentaire MAST (le « Praticien ») published by ENPS (the “Publisher”).

By accessing or using the Practitioner’s website (the “Site”), you agree to be subject to these general terms of use (the “GTU”).

These expressly include by reference the personal data protection policy applicable to the Site, the Site’s cookie charter and the Site’s legal notices.

If you do not accept these GTU, please do not use the Site.

Modifications

The Publisher reserves the right to modify the T&Cs unilaterally and at any time, and without notice.

We therefore invite you to regularly check the T&Cs to be aware of these modifications.

Your continued use of the Site following the posting of any modifications implies your acceptance of said modifications.

Access to the Site

Access to the Site by any user is reserved for strictly personal use; when using the Site, you act in a private capacity.

Site Content and Limits of Use

Except for elements belonging to/modified by the Practitioner or any third party, all content on the Site or accessible via the Site, including texts, graphic representations, user interfaces, visual interfaces, photographs, brands, logos, videos, images, applications, programs, computer code and any other information (collectively referred to as “the Content”), including, but not limited to, the design, layout, look and feel and arrangement of said Content, are the property of the Publisher or its licensors and are protected by copyright, trademark law and other laws relating to intellectual property and unfair competition.

You may print or download the Content from the Site for your strictly personal, non-commercial, informational or educational use, provided that you keep intact all notices relating to copyright and other property rights.

You may not in any way copy, broadcast, distribute, modify, publish, reproduce, store, transmit, post, translate or create other derivative works, nor sell, rent or license all or part of the Content, products or services obtained from this Site, by any means and to anyone, except as otherwise expressly authorized by the T&Cs, by a license, a subscription contract or explicit authorization from the Publisher.

You agree not to reverse engineer, disassemble, decompile or translate any software in the Content, or otherwise attempt to obtain the source code of said software, except as expressly permitted by applicable law, without the prior written consent of the Publisher.

You agree not to systematically retrieve Content in order to create or compile, directly or indirectly, a collection, compilation, database or directory without the prior written consent of the Publisher.

The Publisher shall not be held liable for content specifically published by or at the request of the Practitioner or any person external to the Publisher.

Furthermore, the Publisher shall not be held liable for any element that does not comply with the Charter of the Council of the Order of Dental Surgeons.

Unless expressly authorized by the Publisher, you agree not to use any robot, spider, crawler, or other automatic downloading program, algorithm, or device, or any similar or equivalent manual process to: (i) search, extract, create deep hyperlinks, or index any Content continuously and automatically; (ii) collect personal information from the Site for the purpose of sending unsolicited or unauthorized material; or (iii) cause an interruption in the operation of the Site or in the use of the Site by a third party.

If the Site contains robot exclusion files or headers, you agree to respect them and not to use any device, software, or routine to circumvent them.

You agree not to attempt to gain unauthorized access to any portion or feature of the Site, any other systems or networks connected to the Site or to any Elsevier server, or any products or services provided by, accessible through, or distributed through the Site.

You shall not probe, scan, or test the vulnerability of the Site or any network connected to the Site, or compromise the security or authentication measures of the Site or any network connected to the Site.

You may not use this Site to download and redistribute public information or contributory software for personal profit, or distribute multiple copies of public domain information or contributory software.

Rights and Permissions

Any questions as to the extent to which any particular use is permitted and any requests for permission to publish, reproduce, distribute, display or make derivative works from any work published by the Publisher, any image or other content should be directed to the Publisher.

Contents Provided to the Publisher or Posted Online on or Via the Site

We do not claim ownership of any content, applications or other materials provided by the Practitioner or any third party (including opinions and suggestions) and we are in no way responsible for their content, accuracy or compliance with applicable laws and regulations.

The Site may contain hyperlinks to third-party sites or resources.

Transactions that may occur between you and any third party are solely between you and this third party and are not the responsibility of the Publisher.

Since the Publisher is in no way responsible for the availability or accuracy of these external resources and content, you must check the content of the terms and conditions and the privacy policies of these sites accessible by links, to the extent that their policies may be different from ours.

Exclusion of Warranties and Liability

The Publisher’s liability can only be incurred for acts that are directly attributable to it and that cause it harm directly linked to these acts.

It cannot be incurred for indirect harm.

The Publisher’s liability cannot be incurred due to the misuse of the Site by you or any fault on your part or due to acts attributable to a third party.

Furthermore, in accordance with Article 6-I, 2 and 3 of Law No. 2004-575 of June 21, 2004 on confidence in the digital economy, the Publisher cannot be held liable for the content made available on the Site by the Practitioner, unless it did not make them promptly inaccessible after being informed of their illegality under the conditions provided for by this law.

Finally, the Publisher declines all responsibility with regard to the services provided by the Practitioner, to which it remains foreign.

Neither the Publisher, nor its suppliers or licensors, grant any guarantee whatsoever, including, but not limited to, the guarantee that the operation of the Site will not be interrupted or that it does not contain errors, that defects will be corrected, that the Site, including the server that allows the Site to operate, does not contain viruses or harmful components; nor any guarantee of accuracy, completeness, reliability, availability, validity, quality, non-infringing nature of the operations or results that could result from the use of any Content, services provided by the Site, accessible on or via the Site.

To the fullest extent permitted by applicable law, no liability is assumed for any harm, and/or damage, negligence or otherwise, or resulting from the use or implementation of any ideas, instructions, methods or procedures contained in this Site.

Applicable law and attribution of jurisdiction

These T&Cs are subject in all respects to French law.

The parties agree to do their utmost to resolve amicably any dispute that may arise from the interpretation, execution and/or termination of the T&Cs.

In the absence of an agreement within one (1) month, said dispute will be subject to the exclusive jurisdiction of the French courts, even in the event of an incidental claim or warranty claim or multiple defendants.

Any dispute that may arise from the interpretation or execution of the T&Cs will be subject to the jurisdiction of the competent court within the jurisdiction of the Paris Court of Appeal.
